Article 1 This Self-government Ordinance is enacted by Taipei City (hereinafter referred to as the "City") to enhance the management of delivery platform operators. Article 2 The competent authority of this Self-government Ordinance is the Taipei City Government (hereinafter referred to as the "City Government"), except that for matters stipulated in this Self-government Ordinance that involve the powers and duties of the competent authorities subordinate to the City Government for the relevant business, such matters shall be executed by such competent authorities. Article 3 The terms used in this Self-government Ordinance are defined as follows: (1) Delivery platform: a platform that uses electronic commerce technologies in the Internet transactions, to provide opportunities for customers to purchase products and for delivery persons to choose to accept orders to provide delivery services for the goods purchased by the customers. (2) Delivery platform operator: a business that establishes and operates the platform referenced in the preceding subparagraph. (3) Delivery person: a delivery service provider who, via application programs of the delivery platform, picks up products from the stores designated by customers and transports and delivers them to the locations designated by the customers. (4) Delivery service period: the time period from when a delivery person accepts an order of products purchased by a customer via the delivery platform application program until the delivery person completes the delivery of the products in accordance with the customer's instructions. Article 4 After a delivery person enters into a delivery service contract with the delivery platform operator, the delivery platform operator shall, at its own expense, purchase personal injury insurance for the delivery person as the insured pursuant to the following subparagraphs: (1) Insurance covering disability or death due to accidental injuries, with a minimum insured amount of NTD 2,000,000. (2) Insurance covering medical expenses incurred due to accidental injuries, with a minimum insured amount of NTD 30,000 for reimbursement insurance and NTD 1,000 per day for daily benefit insurance. Delivery platform operators shall transfer the certificates of insurance or insurance manuals regarding the insurance policies referenced in the preceding paragraph to the delivery persons, shall maintain the validity of the insurance policies referenced in the preceding paragraph throughout the duration of delivery service contracts, and may not exclude compensation for accidents occurring outside of the delivery service period. Delivery platform operators shall make available the underwriting approval documents provided by proposers and insurers for the insurance referenced in Paragraph 1, shall keep these documents for at least six months after the expiration of the insurance policies and shall publicly disclose the number of insured delivery persons as well as the insurance coverage referenced in Paragraph 1. In the event of any changes, these documents shall be updated accordingly. Before performing the obligations stipulated in Paragraph 1 and Paragraph 2, delivery platform operators shall not have delivery persons provide delivery services. Article 5 During the suspension of work announced by the government due to natural disasters, delivery platform operators shall halt delivery service and notify delivery persons, with the exception where there is a justifiable reason concluding that there are no significant or predictable risks. Article 6 When a delivery person experiences either of the following circumstances during the delivery service period, the delivery platform operator shall notify the Taipei City Labor Inspection Office within eight hours from knowing or having reasons to know such circumstances: (1) Death; (2) Casualties suffered by more than one person that require hospitalization. Article 7 When a delivery platform operator provides or participates in food delivery service, its management of food safety and sanitation shall comply with the following requirements: (1) Establish one or more sanitation management personnel and comply with the ratio requirement announced by the Department of Health, Taipei City Government (hereinafter referred to as the "Department of Health"), and these sanitation management personnel shall receive a certain number of hours of education and training on sanitation. (2) Designate sanitation management personnel to manage the sanitation of delivery persons and delivery containers. Produce daily records during the period of delivery service, and keep the records for five years for the Department of Health to inspect. Article 8 Before new delivery persons begin to provide delivery service, each delivery platform operator shall provide its new delivery persons with no less than three hours of education and training courses on occupational safety, food safety and sanitation, and traffic safety. Article 9 The City Government shall publicly announce, on a quarterly basis, the related statistics of delivery persons encountering traffic accidents in this City. In the event that the traffic accident statistics announced by the City Government are higher than the previous quarter, the corresponding delivery platform operator shall draw up a plan for reducing traffic accidents involving delivery persons, and shall submit the plan to the City Government for its record within one month from the announcement of such traffic accident statistics. Article 10 Delivery platform operators shall keep each of the following types of electromagnetic records for at least one year, and the relevant authorities may review them if necessary: (1) The time and contents of customers' orders of products. (2) The time and contents of stores' acceptances of orders. (3) The time, locations and contents of delivery service provided by delivery persons. (4) The payment records of customers. Article 11 Delivery platform operators shall clearly disclose each of the following items on their delivery platforms: (1) The product price, service fee or delivery fee. (2) Mechanisms for customers to cancel orders and to claim refunds. (3) Justifications for delivery platform operators to cancel orders and the mechanism for refunding customers. (4) Methods of handling a delay in delivery of goods. (5) Methods of handling situations where the types or quantities of delivered products are inconsistent with the order and the products are defective, and the related plans regarding refunds, and indemnifications. Article 12 In any of the following circumstances, a delivery platform operator shall be fined not less than NTD 20,000 and not more than NTD 100,000: (1) For a violation of Article 4 or Article 6. (2) For a violation of Article 5. (3) Without any justifiable reason, avoiding, obstructing or refusing an inspection conducted by the relevant authorities pursuant to this Self-government Ordinance. Article 13 A delivery platform operator who violates Subparagraph 2 of Article 7 shall be fined not less than NTD 20,000 and not more than NTD 80,000. A delivery platform operator who violates Subparagraph 1 of Article 7 or Paragraph 2 of Article 9 and fails to make corrections by the prescribed deadline after being notified of a correction requirement, shall be fined not less than NTD 20,000 and not more than NTD 80,000, and may be fined consecutively per violation. Article 14 A delivery platform operator who violates Article 8 and fails to make corrections by the prescribed deadline after being notified of a correction requirement shall be fined not less than NTD 30,000 and not more than NTD 60,000, and may be fined consecutively per violation. A delivery platform operator who violates Article 10 shall be fined not less than NTD 30,000 and not more than NTD 60,000. Article 15 In the event that a third party, instead of a delivery platform operator, enters into a delivery service contract with a delivery person, Article 4 to Article 8 as well as Article 12 to Paragraph 1 of the preceding Article shall apply mutatis mutandis to such third party. Article 16 This Self-government Ordinance shall come into effect on the date of promulgation.
