Article 1 For the purpose of carrying out the audit as set forth in the Waste Disposal Act (the ?Act?), the Department of Environmental Protection (the ?DEP?) of Taipei City government (the ?Government?) formulates this regulation which ensures proper administrative penalties are enforeced to achieve the purpose of the Act. Article 2 The audit (inspection) personnel of the DEP shall, carrying out audits and giving notices, produce their identity documents or wear proper accreditation badges. Article 3 When carrying out audits or giving notices in accordance the regulation, the audit (inspection) personnel of the DEP shall, by taking photos or recording video using cameras, camcorders or video recorders, collect evidence of the behaviors or facts of the persons breaching the Act and in case they drive vehicles or motorcycles, the above evidence should include the number of licensed plates which will serve as the basis for verifying identities of drivers and their behaviors breaching the Act. Article 4 When carrying out audits or giving notices per this regulation, the audit (inspection) personnel of the DEP shall require a person breaching this Act show his/her identity document so that proper penalties or notifications may be given. In case of his/her refusal to do so for no good reason, failure to possess any identity document or giving false identity information, our audit personnel shall, after taking photos or recording video of his/her illegal acts, clearly inform him/her that due to his/her behaviors breaching this regulation, the above photos or videotapes obtained will be shown to the police department, civil affair bureaus or nearby community residents to verify his/her identity. In case a person breaching this Act fails to produce his/her identity information or the information he/she gives is not accompanied by any supporting document after being informed by the audit (inspection) personnel of the DEP in accordance with the above notification procedure, our audit (inpsection) personnel shall file the facts of his/her breaching behaviors and relevant observations in the audit (inspection) records. Article 5 People may report to the Government or the DEP any breach of the Act by giving details of the breach together with evidentiary materials and the DEP shall verify the identity of the person breaching this Act by showing the above materials to the police department, civil affairs bureau or nearby community resident. The above report submitted by an anonymous person or failing to prove the breach of the Act will not be admitted. Article 6 Anyone breaching this Act will, once his true identity is finally verified, be punished by our imposing penalties for breaching this Act in addition to those imposed due to his refusal to produce his identity information. Article 7 In case any breach of this Act is proven by taking evidence through video recording, the audit (inspection) personnel of the DEP shall, on daily basis, check the content of the recorded video and give notifications to those shown in the video to have performed behaviors breaching this Act. However, in the event that videotapes can not be retrieved each day for any reason and their content shows more than one violation by the same persone of the provisions of the Act, one penalty may be imposed upon him concurrently depending upon the severity of his breaching behavior. This also applies to a report submitted by people and containing multiple pieces of video evidence. Article 8 This regulation will be enforced as of the date it is published.
