Article 1 This Regulations is promulgated in accordance with Paragraph 2, Article 6 of the Taipei City Self-Government Ordinances for Consumer Protection. Article 2 For purpose of this Regulations, a major consumption disaster shall mean one of the following events: 1. 3 or more consumers have died, 5 or more have hurt seriously, or 20 or more have suffered sudden physical injury, health impairment or property damage as a result of a safety or sanitation violation by a trader operating a place of consumption or providing merchandise or services in this City; or 2. any other event that is deemed by the Taipei City government (hereinafter referred to as "this Government") to have a major impact on the public safety or consumer rights or interest. Article 3 This Government may provide the following legal assistances in the event that a major consumption disaster occurs: 1. assisting the consumers in investigating the relevant information, such as assets, etc., of the trader and other responsible persons under the relevant laws to facilitate the consumers to apply for provisional attachment with courts; 2. assisting in the handling of settlement and damages claims; 3. conferring with or supporting the Consumer Advocacy Groups or other lawfully established legal assistance groups to institute litigation to claim damages; and 4. providing legal consultation. Article 4 The legal assistance set forth in Item 1 of the preceding Article shall be jointly rendered to consumers by the executing organization and consumer ombudsmen through collecting from the respective purpose industry competent authorities of this Government the names, dates of birth, ID numbers or Government Uniform Invoice Numbers, addresses, real estate holdings and vehicle registrations, etc. of the trader, person in charge thereof, and other responsible persons under the relevant laws. Article 5 The legal assistance set forth in Item 2, Article 3 shall be rendered to consumers by the executing organization or consumer ombudsmen in accordance with the provisions of the consumer protection laws. Article 6 The legal assistance set forth in Item 3, Article 3 shall be rendered to consumers by the executing organization or consumer ombudsmen protection officer by conferring with and requesting the Consumer Advocacy Groups or other lawfully established legal assistance groups to so provide. Article 7 The legal assistance set forth in Item 4, Article 3 shall be rendered to consumers joint by the executing organization and consumer ombudsmen by conferring with and requesting the Consumer Advocacy Groups or other lawfully established legal assistance groups to appoint special legal counsel. Article 8 Taking into account its annual budget, this Government may provide support for the legal assistances referred to in Article 6 and the preceding Article by way of travel expense, consultation fee or other necessary costs or expenses. The money needed for supporting the action referred to in the preceding paragraph shall be funded by the annual budgets of the respective executing organization and the Department of Legal Affairs of this Government. Article 9 The application for legal assistance by a victimized consumer or any parent, children or spouse of a deceased victim shall be submitted to the executing organization or consumer ombudsmen in writing, specifying therein the following items: 1. the name and address or residence of the victim, the name and address or residence of the legal representative, if any, and his/her relationship with the victim; 2. a description of the consumption disaster event and the relevant evidence; and 3. the items for which he legal assistance is applied. Article 10 This Regulations shall be implemented on the date of promulgation.
