Article 1 Taipei City Government ("City Government") enacts these Directions for handling applications from appellants, interveners, administrative appeal representatives, or third parties (collectively, "Applicant") to review, record, copy, or photograph files in administrative appeal case bundles, or the evidence on which a relevant government agency based a particular administrative disposition. Article 2 The Applicant may apply in writing or online to review files after the City Government receives an administrative appeal case. Article 3 Where the City Government receives an application to review files and such application is granted, the case officer shall notify the Applicant to review the files at a designated place on a scheduled date. The date for the review of files as referred to in the preceding paragraph shall be scheduled within ten (10) days after the date of the receipt of the application. Article 4 If the Applicant cannot review the files on the scheduled date, notifies the City Government and applies for a rescheduled date beforehand, the City Government shall reschedule the date and proceed with the process as stipulated at Article 3 of these Directions. Article 5 After reviewing a received application, if the City Government finds that the relevant files are forbidden from review, or restricted from disclosure pursuant to the Administrative Appeal Act, the Archives Act, the Freedom of Government Information Law, or other regulations, or if there exist any other inappropriate circumstances, the City shall refuse such application and specify the reasons for the refusal. The refusal as referred to in the preceding paragraph shall be made in writing. Article 6 Applicant shall present his/her identification documents and appear before the City Government on the date scheduled for the review of the files; if Applicant has appointed an agent to conduct the review, such agent shall present a Power of Attorney(POA) and the agent's identification documents. Applicant or the agent shall sign their names or impress their seals on the file review registration book, and ask the case officer for the files. After the reviewing is completed, Applicant or the agent shall fill in the time when the reviewing was completed and affix thereon his/her signature, and return the original files to the case officer for checking and receipt. Article 7 Applicant or his/her agent may be accompanied by another person to assist with the copying, recording, or photographing of the files. The said accompanying person shall present his/her identification documents and write his/her name in the file review registration book. However, said accompanying person cannot copy, record, or photograph the files alone without Applicant or agent being present. Article 8 The file review shall be conducted at the designated place on the scheduled date, and the Applicant/agent shall comply with the following rules: 1. No taking notes in/on, altering, replacing, extracting, marking, or damaging the files; 2. No breaking up the files; 3. The files shall be stored in their original state after review; 4. No other acts that may damage the files; and 5. No files are to be taken out of the designated place. The file review may be discontinued, and further applications may be declined, if Applicant violates any of the rules as stipulated in the preceding paragraph. Article 9 Applicant or his/her agent shall keep the information obtained pursuant to these Directions confidential, and use of such information is strictly limited to use in/with the relevant administrative appeal case.
