- Article 1These regulations are promulgated by TAIPEI CITY GOVERNMENT ("The Government") to control number of persons accommodated in specific places in Taipei City, maintain public safety and fulfill the regulations under Article 95-1 of Autonomous Regulation of Land Use Districts Control in Taipei City.
- Article 2The competent authority of these regulations is the Government, with division of authority and responsibility as follows:
1. Department of Urban Development of the Government:
(1) Checks on record sheets for control number for persons accommodated will be transferred and performed by fire department of the Government, with cooperative enforcement of water or electricity supply suspension and handling on application for water or electricity supply restoration where the confirmations on original approval for usage and usage area and public safety checks are performed and any violation to these regulations is found.
(2) Confirmation on land use districts and groups for specific places, and execution on dispositions from violation of Article 95-1 of Autonomous Regulation of Land Use Districts Control in Taipei City and Articles 79 and 80 of Urban Planning Act.
2. Department of Economic Development of the Government: Confirmation on business items for specific places. Where the commercial inspections are performed, if any violation to these regulations is found, record sheets for control number of persons accommodated will be transferred to the Fire Department.
3. Police Department of the Government: Where a police raid is performed at a specific place, if any violation to these regulations is found, the raid record sheet will be transferred to the Fire Department for compilation, and maneuvers personnel on resolution should there be any obstructions upon checks by relevant authorities in specific profit-seeking places.
4. Fire Department of the Government: Approval, inspection and identification on number of people in specific places, compilation of inspection information to relevant authorities, and performance of field inspection by requesting relevant authorities when necessary. - Article 3The terms used in these regulations are as follows:
1. Specific places: refers to ballrooms, dance halls, pubs, bars, liquor stores (clubs), audio-visual sing as well as places, department stores, supermarkets, and similar places with a floor area used over 5,000m2.
2. Relevant architectural technologies and fireproof design terms listed in these regulations applies definitions of terms as used in architectural technologies regulations and Standard for Installation of Fire Safety Equipments Based on Use and Occupancy ("Standard for Installation").
3. Persons accommodated: refers to the total number of customers, employees and other people on site.
4. Persons accommodated floor area: refers to total floor area actually used in specific places. - Article 4Number of persons accommodated in specific places shall be calculated with its control number using Control Number of Number of Persons Accommodated (Attachment I). Where Article 157 of the Standard of Installations concerning refuge appliances is applied to a specific place, the refuge appliances shall be selected following the control number of persons accommodated as approved under these regulations.
- Article 5Business owners running specific places shall declare to the Fire Department for approval on control number of persons accommodated; where the calculation basis for the approved control number of persons accommodated has changed and therefore a recount for persons accommodated needs to be made shall also be declared. For the aforementioned format of application form, see attachment II. Where the Fire Department receives the aforementioned application, a field inspection by requesting relevant authorities shall be made when necessary.
- Article 6Business owners running specific places shall install the sign for number of persons accommodated and "Fully Occupied" signs at the obvious spots of the main business entrance; the formats, characters of signs and contents shall follow the rules in Attachment III.
- Article 7Where the number of persons accommodated reaches control number, Business owners running specific places shall perform control following the control number as marked on the sign of number of persons accommodated and equip "Fully Occupied" sign on site to inform the consumers.
- Article 8Where any of the following conditions occur on business owners running specific places, the Fire Department shall perform guidance in writing and guidance for ratification within the certain period:
1. The owner fails to declare the control number of persons accommodated.
2. The owner does not equip signs stating number of persons accommodated and "Fully Occupied" signs.
3. Formats, characters or content on the signs of persons accommodated and "Fully Occupied" sign does not meet the requirements.
4. Mislabeling of control number of persons accommodated.
Where the business owners fail to perform controls based on approved control number of persons accommodated following these regulations, a ban on its excessive use may be enforced. Should the owner refuse to ratify, relevant enforcement following Articles 79 and 80 of the Urban Planning Act will be made, and a compulsory evacuation and ban on entry will be enforced promptly following Articles 32 and 36 of the Administrative Execution Act if necessary. - Article 9Where relevant authorities of the Government finds any violation to the first paragraph of the preceding article, the authority may request improvement and record and check the status on the record sheets before mailing to the Fire Department for written guidance and improvement. Should the owner fail to improve, the Fire Department may request relevant authorities to form an inspection group for concentrated check and count of people, and countermeasures following paragraph 2 of the preceding article will be made if the number of people exceeds control number. Where the relevant authority of the Government finds the violation to the paragraph 2 of the preceding article at specific places, the authority may request for improvement and record and check the status on the record sheets before mailing to the Fire Department of the Government. The Fire Department will make a sheet for delivery to Department of Urban Development of the Government for preparation of disciplinary citation.
- Article 10Where the enforcement of water or electricity supply suspension at a specific place reaches 3 months, fines for violation has been paid up, and no violation of relevant regulations in these regulations is found, the business owner of the specific place may apply for restoration of water or electricity supply.
- Article 11To maintain public safety, competent authority may apply these regulations after designation on indoor places with crowds gathering such as exhibitions and performances. The business objective authority will be in charge of the aforementioned designated places as well as the management of persons accommodated; the Fire Department will be in charge where the specific places are without any authority for such.
- Article 12These regulations are effective from the date of announcement; however, the rules in Articles 8 to 10 are effective after 6 months from the announcement date. The amendments of these regulations are effective from the announcement date.
